END USER LICENSE AGREEMENT

ACCEPTANCE

This document "End User License Agreement for Beta Testing" or ("BETA EULA") is a legal agreement between You ("You", "End User" or "User") and Lumion Technologies Limited, a company with registered and business offices at #1650, Arlington Business Park Theale, Reading Berkshire, RG7 4SA, UNITED KINGDOM (the "Company", "We", "Us") and governs Your use of our game – "Lokko" or the "Game", whether or not You are a registered End User of the Company or Lokko.

PLEASE NOTE THAT BY ACCESSING AND/OR PLAYING THE GAME, YOU AGREE TO ABIDE BY AND BE BOUND BY THIS BETA EULA. YOUR ACCESSING AND PLAYING OF THE GAME CONSTITUTES YOUR ACCEPTANCE OF THIS BETA EULA. IF YOU DO NOT AGREE TO THE TERMS HEREIN, PLEASE DO NOT ACCESS AND PLAY THE GAME.

You hereby understand and acknowledge that this pre-release version of the Game and any software programs or files that are provided to You (via online transmission or otherwise) including 'patch,' or 'update', as well as any online or electronic documentation, and any and all copies and derivative works of such Game and any accessory software programs therein are the copyrighted work of the Company.

GRANT OF LICENSE

The Company hereby grants You a limited, personal, non-exclusive, non-transferable, non-assignable and fully revocable license to use the Game, and any content therefrom for your individual, non-commercial, entertainment purposes only, subject to Your compliance with this BETA EULA.

The license includes the right to install and use one (1) copy of the Game for Your personal use on Your computing device or hardware which You own or which is under Your personal control.

You may not:

• Sub-license, or charge others to use or access the Game
• Translate, reverse-engineer, reverse-compile or decompile, disassemble or make derivative works from the Game
• Modify the Game or use it in any way not expressly authorized in writing by Us

OPEN BETA OPERATION

When you use the Game, your IP address may be stored in our records. When the Game is updated or "patched," our patch routine may check your device to see that you have the most recent version of game-specific files.

By opting in to the Open Beta, You agree that:

• Participation in the Open Beta is at Your own risk
• The Game may include known or unknown bugs
• Any value or status indicators that You achieve through game play may be erased at any time
• The Company has no obligation to make the Game available for play without charge for any period of time

YOUR RESPONSIBILITIES AS A TESTER

You agree that You shall not, under any circumstances:

• Sell, grant a security interest in or transfer reproductions of the Game to other parties
• Rent, lease or license the Game
• Transfer, sell or disclose any CD-key, serial number, activation code, or other unique identifier
• Exploit the Game for any commercial purpose
• Host, provide or develop matchmaking services for the Game
• Create or maintain unauthorized connections to the Game

INTELLECTUAL PROPERTY AND USER GENERATED CONTENT

All title, ownership rights and intellectual property rights in and to the Game are owned by the Company or its licensors and are protected by copyright, trade dress, patent, and trademark laws.

You grant the Company a worldwide, royalty-free, irrevocable, perpetual, non-exclusive, and sub-licensable license to use, reproduce, modify, adapt, publish, translate, distribute, perform, and display all or any portion of your User Generated Content.

NO WARRANTIES

You accept the software "as is," and the Company makes no warranty as to its use, performance, or otherwise. To the maximum extent permitted by applicable law, the Company disclaims all other representations, warranties, and conditions, express, implied, statutory, or otherwise.

LIMITATION OF LIABILITY

In no event shall the Company be liable for any costs of substitute products or services, or for any special, incidental, indirect, or consequential damages whatsoever arising out of this BETA EULA or the use of or inability to use the Game.

TERMINATION

This BETA EULA is effective from the earlier of the date of purchase, download or use of the Game, until terminated according to its terms. Both you and the Company may terminate this EULA at any time for any reason or for no reason.

You may terminate this Beta EULA by notifying the Company at support@appymonkeys.com

GOVERNING LAW AND JURISDICTION

The terms of this BETA EULA shall be construed in accordance with the laws of England and Wales and the courts of London, United Kingdom shall have sole and exclusive jurisdiction over any such disputes.
